These Terms of Service ("Terms") govern your access to and use of the Marketing OS platform at aimkos.app and related services operated by Mindpace Ltd ("we", "us", "AIMKOS"). By creating an account or using the service, you agree to these Terms.

1. The service

AIMKOS provides software for AI-assisted marketing — including content creation, social publishing, engagement management, analytics, ad optimization, and related tools. Features vary by subscription plan.

2. Accounts and eligibility

You must provide accurate registration information and keep your credentials secure.
You must be at least 18 years old or have authority to bind your organization.
You are responsible for activity under your account and connected integrations.

3. Acceptable use

You agree not to:

Use AIMKOS for unlawful, harmful, or deceptive marketing practices
Violate third-party platform policies (Meta, X, Google, etc.) when publishing or engaging
Attempt to access other tenants' data or circumvent security controls
Reverse engineer, scrape, or overload the service without permission
Upload malware or content that infringes others' rights

4. AI-generated content

AIMKOS uses artificial intelligence to suggest content, replies, and recommendations. You are responsible for reviewing outputs before publishing or sending. We do not guarantee that AI-generated content is accurate, lawful, or suitable for your audience.

5. Connected platforms

When you connect third-party accounts, you authorize AIMKOS to access and act on those platforms according to your settings and approvals. Disconnecting integrations may limit functionality. Third-party services are governed by their own terms.

6. Subscription and billing

Paid plans are billed in advance on a recurring basis unless cancelled. Fees are non-refundable except where required by law. We may change pricing with reasonable notice. Failure to pay may result in suspension.

7. Data and privacy

Our collection and use of personal data is described in our Privacy Policy. You retain ownership of content you upload; you grant us a license to process it to provide the service.

8. Intellectual property

AIMKOS, its branding, software, and documentation are owned by Mindpace Ltd or its licensors. These Terms do not grant you rights to our trademarks or source code.

9. Disclaimer of warranties

The service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.

10. Limitation of liability

To the maximum extent permitted by law, Mindpace Ltd shall not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill arising from your use of AIMKOS.

11. Termination

You may cancel your account at any time. We may suspend or terminate access if you violate these Terms or if required for security or legal reasons.

12. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws of Uganda, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Kampala, Uganda, unless otherwise required by applicable law.
